Trial Terms

These terms cover a free trial of HaSafety. They are between Houssein Hassan Daher, carrying on business as "HaSafety" ("HaSafety", "we", "us"), and the company trying the service ("you", "your company").
If your company later pays for HaSafety, a separate paid agreement will replace these terms and you will be asked to accept it.
1. What the trial is
We give your company access to HaSafety at no charge for 30 days so you can decide whether it suits you. There is no fee and no obligation to continue.
We may set reasonable limits on how many people can be added, and we will tell your administrator what they are. We can extend the trial if we both agree.
2. What you can do with it
Use it for your own safety work: file hazard assessments, record inspections and incidents, track certifications, and produce reports for your clients and auditors.
Do not resell it, copy the software, attempt to break its security, or use it to store information unrelated to your safety programme.
3. Who may use it
Only people your company authorises. Your administrator adds and approves accounts and is responsible for who has access and for removing people who leave.
Each person keeps their own password. Tell us promptly if you believe an account has been used by someone it does not belong to.
4. Your data is yours
Everything your company puts into HaSafety belongs to your company. We claim no ownership of it.
We use it only to run the service for you, as described in our Privacy Policy. We do not sell it, and we do not use your safety records to train AI models.
You can export your records at any time from inside the app. If you leave, ask and we will help you get a full copy.
5. What we promise, and what we do not
We will run the service with reasonable care and take the security measures described in our Privacy Policy.
During a free trial the service is provided "as is". We do not promise it will be available at any particular time, that it will be free of faults, or that it will fit a purpose you have not told us about. There is no uptime guarantee on a trial.
6. HaSafety records safety work — it does not perform it
This matters more here than in ordinary software, so it is stated plainly.
HaSafety is a record-keeping and reminder tool. It is not a safety advisor, an inspector, or a substitute for a competent person.
- Deciding whether work is safe, whether a hazard is properly controlled, and whether a worker is competent for a task remains entirely your company's responsibility.
- Warnings, readiness percentages, competency gates and expiry reminders are aids. They depend on what your people enter, and they can be incomplete or out of date.
- AI-generated drafts are drafts. A qualified person must review them before they are relied on.
- Nothing in HaSafety is legal advice, and using it does not by itself make your company compliant with occupational health and safety law.
Your company remains responsible for meeting its obligations under Alberta's Occupational Health and Safety Act and any other law that applies to it.
7. Limitation of liability
To the fullest extent the law allows:
- We are not liable for any indirect, incidental, special, consequential or punitive loss, including lost profits, lost business, lost data, or the cost of substitute services.
- We are not liable for any injury, incident, fine, penalty, claim or loss arising from safety decisions made by your company or its people, whether or not HaSafety was used in making them.
Nothing in these terms limits liability that cannot be limited by law.
8. Stopping
Either of us can stop the trial at any time, for any reason, with no notice required.
If your company stops, tell us and we will close the account. Your data is deleted from the live system as described in the Privacy Policy; ask first if you want a copy.
If we stop the trial — for example because it has run its course, or the service is being misused — we will give your administrator reasonable notice and a chance to export, except where misuse requires us to act immediately.
9. Confidentiality
We treat your safety records as confidential and will not disclose them to anyone outside HaSafety except our sub-processors, or where the law requires it.
You will not publish benchmarks or details of the service's internal workings without our agreement.
10. Changes to these terms
We may update these terms. If we do, your administrator will be asked to accept the new version the next time they sign in. Continuing to use the trial after that means accepting it.
11. Law
These terms are governed by the laws of the Province of Alberta and the laws of Canada that apply there. The courts of Alberta have jurisdiction.
